Release and Waiver of Liability and Indemnity Agreement
By signing your student enrollment agreement with TAIJUTSU you also agree to the terms detailed in this Liability Waiver.
The Student hereby represents that they are physically fit to receive and participate in the prescribed course of instruction and will faithfully comply with all the rules and regulations of TAIJUTSU and the traditions of the martial arts; if The Student is unfit for practice of Martial Arts, this should be notified to TAIJUTSU immediately and practice should cease until a doctor has given clearance.
The Student understands and agrees that martial arts is dangerous and that TAIJUTSU will not be held liable for injuries, damages etc. not caused by or resulting from the negligence of the owners, operators, employers or persons in charge of such establishment.
I understand that there are risks and dangers in participating in martial arts, fitness activities and that in order to participate, in any such activities, including but not limited to TAIJUTSU or other martial arts classes or training, including classes and training involving the use of fitness equipment, I must give up my rights to hold TAIJUTSU and any other entity or charity associated with TAIJUTSU, responsible or liable for any damage that I may suffer while participating in such classes, training, or seminars provided by TAIJUTSU, waiting at or on TAIJUTSU premises to participate in such classes / training, walking through the premises at TAIJUTSU prior to or after such classes. Knowing this and in consideration for being permitted to participate in martial arts classes or training with TAIJUTSU, I hereby voluntarily forever release, discharge and hold completely harmless TAIJUTSU, and all other entities or charities associated with TAIJUTSU, and their members, offices, directors, agents, employees, heirs, assigns and independent contractors from any and all responsibility for, or liability resulting from or arising from, my participating in martial arts classes or training at TAIJUTSU, and being on the premises at TAIJUTSU.
I understand that TAIJUTSU classes provided may include, but will not be limited to, activities such as kicking, punching, hitting, stretching, twisting, jabbing, lunging, rolling, falling, jumping, joint locks, chokes, vascular restraints and the use of various martial arts and fitness equipment. I realize that these activities, as well as all other martial arts activities, can be dangerous, but I am voluntarily choosing to participate in some or all of these activities and agree to assume the risk associated with my participation therein.
I understand that I am assuming full responsibility for any and all risks of death, personal injury, emotional pain and suffering, property damage and economic loss that might be suffered by me as a result of my participation in martial arts classes at TAIJUTSU. I agree that this release shall bind me, my spouse, my heirs, my personal representatives, my assigns, my children and my and their agents. I hereby further agree to release, indemnify and hold completely harmless TAIJUTSU, and all other entities associated with Taijutsu, and their members, officers, directors, agents, employees, heirs, assigns and independent contractors harmless from any and all liability and costs, including attorney fees, associated with or arising from my participating in martial arts classes or training at TAIJUTSU, waiting at or on TAIJUTSU premises to participate in such classes or training, and walking through the premises at TAIJUTSU prior to or after such classes or training.
I understand that if I were to file a lawsuit against TAIJUTSU, or any other entity associated with TAIJUTSU and/or their members, officers, directors, agents, employees, heirs, assigns and independent contractors, as a result of any personal injury including death, emotional pain and suffering, property damage or economic loss suffered by me as a result of my participation in martial arts classes or training at TAIJUTSU, waiting at or on TAIJUTSU premises to participate in such classes or training, and walking through the premises at Taijutsu Brisbane prior to or after such classes or training, that this release would bar the lawsuit and the court would dismiss it on the grounds that by signing this release, I have expressly assumed all the risks associated with participation in such activities, including but not limited to negligence on the part of the martial arts or fitness instructors in the performance of their duties, negligence by other members of TAIJUTSU, negligence in the operation of machinery or equipment, and/or premises liability.
If I am agreeing to this release on behalf of a minor child, I understand that I am giving up the same rights for the said minor as if I agreed to this release on my own behalf. I have read this agreement and understand the words and language in it and I am advised of all potential dangers incidental to participation in martial arts classes/training at TAIJUTSU, including travel to and from.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT, AND HAVE AGREED TO IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY ACCEPTANCE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
