TERMS AND CONDITIONS

Definitions:

  1. TAIJUTSU, we, us, our: Taijutsu Martial Arts. METAHUMAN PTY LTD. ABN: 88 637 686 965. Unit 2, 110 Logan Road, Woolloongabba, 4102. info@taijutsu.org

  2. You, Your, Member: You, Your, Member refers to the name in which the membership has been created, which at times may differ to the party paying for the membership, and includes the parent or guardian of the Member if the Member is under 18 years.

  3. The school, studio, club: Refers to the Taijutsu martial arts club where your membership entitles you to visit.

  4. Agreement: This is the Agreement between TAIJUTSU and you, under which you will become a member of TAIJUTSU.

  5. Minimum Term: The term specified in the Agreement form.

1. Cooling off period

  1. You can cancel your membership with us up to 7 days from the date of purchase. If you cancel within the 7 day cooling off period, TAIJUTSU will refund your money less any set-up fee, the value of any classes already attended.

 

2. Minimum age

  1. The minimum age for training with us is 4 years old. People under the age of 18 are required to provide consent from a parent or legal guardian confirming approval to train with TAIJUTSU with the terms of this agreement being applied to both the student and parent or legal guardian.

 

3. Health and safety

  1. You warrant that you are in good physical condition and you know of no medical or other reason why you cannot or should not do active or passive exercise.

  2. You recognise that the instructor(s) are not able to provide you with medical advice with regard to your fitness, and that this information is used as a guideline to the limitations of your ability to exercise.

  3. You agree to not hold any certified trainer or directors of TAIJUTSU liable for any injury or illness that may occur during or after a training session either in the studio or online.

  4. You have answered "NO" to all the questions on the "Pre-Training Screening" questionnaire. 

  5. You agree to items detailed in TAIJUTSU's Safety and Training Rules 

4. Class bookings

  1. The TAIJUTSU scheduling system allows members to book classes one week in advance. All TAIJUTSU training classes are capped so places are limited. Therefore, online bookings are highly recommended.

  2. If the class is full, we recommend members go onto the waitlist in case of cancellations. If you book a class but subsequently cannot make it, you agree to log in to change or cancel your booking, so that another member on the waitlist can attend.

  3. Failure to book a class or non-attendance, does not relieve your obligations of your membership payments. 

5. Personal property

  1. You understand and agree that TAIJUTSU is in no way responsible for the safekeeping of any personal belongings whilst you attend a class.

6. Paying for membership

  1. Membership fees are paid in advance, weekly by direct debit from a bank account or credit card. I agree to pay the tuition in regular installments over an undefined period of time until the date when I wish to cancel the service. 

  2. TAIJUTSU membership dishonour fees will be applied to each failed digital financial transaction. This dishonour fee is currently $9.95. This fee will be charged directly to your account. These fees can be avoided by ensuring you have sufficient funds available in your nominated payment method.

7. Meeting your payment responsibilities

You must make sure:

  1. Your bank account can accept direct debits,

  2. There are sufficient funds in your bank account on the payment day,

  3. You tell us if you are transferring or closing your account at least 72 hours before the next direct debit,

  4. You tell us about any changes to your credit card, such as its expiry date or number, at least 72 hours before your next debit.

 

8. What happens if your membership payment is declined or fails for any reason?

  1. If you do not fully pay your fees on the due date, TAIJUTSU may suspend access to class bookings until any outstanding balance has been paid and you have given us your updated account details if they are required. TAIJUTSU will continue to debit your nominated account without notice, until TAIJUTSU has received the total amount you owe.

  2. TAIJUTSU membership dishonour fees will be applied to each failed digital financial transaction. This dishonour fee is currently $9.95. This fee will be charged directly to your account. These fees can be avoided by ensuring you have sufficient funds available in your nominated payment method.

  3. TAIJUTSU will make a reasonable effort to advise you on the status of the failed payments by letting you know via the email address you provided.

  4. For membership/s in your name, you must make sure that the payment method you choose remains valid for the length of your agreement. This includes third-party accounts. If the details you give us fail, you are liable for all associated fees. You should ensure your details are up to date and you are obligated to complete your minimum term of payments.


9. Can Taijutsu change this agreement?

  1. TAIJUTSU may sometimes add to, change or remove terms and conditions. This includes changing the opening and closing hours, the services and facilities and membership fees. Sometimes, TAIJUTSU may also close for refurbishment to improve the facilities or by order of a Government authority. If this substantially reduces our ability to provide our service to you, TAIJUTSU will reduce your membership fees accordingly on a pro-rata basis.

  2. The most up-to-date terms and conditions always apply. TAIJUTSU will give you at least 28 days’ notice of any changes. If TAIJUTSU does not fulfil its obligations to you, you may be able to cancel your membership. Unless the law states otherwise, you won’t have any other claim against TAIJUTSU in such an event.


10. Can Taijutsu Increase Fees?

  1. TAIJUTSU reserves the right to increase fees at any time after your agreement has ended or for members that are not under a contract term. TAIJUTSU will make a reasonable effort to advise members at least 28 days prior in writing via email.

  2. TAIJUTSU will consider that you have received the email on the second business day after it is sent. Where TAIJUTSU has made a reasonable effort to let you know about a fee increase, you authorise TAIJUTSU to increase any debits from your nominated account.


11. Suspension and cancellation

TAIJUTSU understands that from time to time you may not be able to train due to becoming injured or wish to cancel/terminate your membership altogether. The following rules apply to voluntary suspensions and cancellations:

 

Suspension

Memberships can not be suspended or paused; except under the following conditions.

  1. Student is injured and cannot participate in regular class activities; supporting medical documentation, date of return to training, and a notification via email to info@taijutsu.org is required. A minimum term of 4-weeks suspension is applied in this circumstance. 

 

Cancellation

Minimum Term Contract Membership:

  1. Applies to:

    • 3-month term membership 

    • 6-month term membership

    • 12-month term membership

  2. Early cancellation of contract fee: 50% of remainder contract value, or 4 weeks - whichever is greater. This amount will be automatically charged on the date of cancellation request.

  3. A cancellation fee does not apply under the following circumstances:

    • Injury resulting in not being able to train for remainder of contract (must provide supporting medical documentation)

  4. In all situations involving your cancellation of a membership, a minimum 4 weeks’ notice is required.

  5. Cancellation notification must be emailed through to info@taijutsu.org

12. Holiday Periods & School Closure

  1. If TAIJUTSU is closed for four weeks or more, you are entitled to a prorated refund, except if the closing is not the fault of the facility; in which case the choice of remedy is at TAIJUTSU's discretion.

  2. TAIJUTSU will close for up to 3-weeks over the Christmas period, dates of closure will be announced 14-days in advance.

  3. TAIJUTSU operates through all school holiday periods.

  4. If a public holiday falls on a day of operation, TAIJUTSU will be closed for that day.

  5. There are no payment suspension or refunds available for holiday periods.

13. Privacy policy

  1. TAIJUTSU understand the importance of, and are committed to complying with, the Privacy Act (1988) and the National Privacy Principles. We only collect information that is necessary for us to effectively manage your tuition payments and provide you with Martial Arts lessons.

  2. In the event of non-payment, we may contact out services that involve disclosing your information to other organisations (including legal advisors and collection agents). This Notice of Consumer’s rights is an integral part of the Application and Agreement for Membership.

 

14. Use of photography

  1. You agree to allow TAIJUTSU to include you in any video, photo or print promotions that have been recorded by an authorised agent of TAIJUTSU immediately outside, within the TAIJUTSU studio or in an online class.
