LIABILITY WAIVER

The Student hereby represents that he/she is physically fit to receive and participate in the prescribed course of instruction and will faithfully comply with all the rules and regulations of the School and the traditions of the Martial Arts; if The Student is unfit for practice of Martial Arts, this should be notified to the School immediately and practice should cease until a doctor has given clearance. 

The Student understands and agrees that martial arts is dangerous and that the school will not be held liable for injuries, damages etc. not caused by or resulting from the negligence of the owners, operators, employers or persons in charge of such establishment.

Release and Waiver of Liability and Indemnity Agreement

 

I understand that there are risks and dangers in participating in martial arts / fitness activities and that in order to participate, in any such activities, including but not limited to Taijutsu or other martial arts classes / training, including classes / training involving the use of fitness equipment, I must give up my rights to hold Taijutsu and any other entity or charity associated with Taijutsu, responsible or liable for any damage that I may suffer while participating in such classes / training / seminars provided by Taijutsu, waiting at or on Taijutsu premises to participate in such classes / training, walking through the premises at Taijutsu prior to or after such classes. Knowing this and in consideration for being permitted to participate in martial arts classes / training with Taijutsu, I hereby voluntarily forever release, discharge and hold completely harmless Taijutsu, and all other entities or charities associated with Taijutsu, and their members, offices, directors, agents, employees, heirs, assigns and independent contractors from any and all responsibility for, or liability resulting from or arising from, my participating in martial arts classes/training at Taijutsu, and being on the premises at Taijutsu Brisbane.

 

I understand that Taijutsu classes provided may include, but will not be limited to, activities such as kicking, punching, hitting, stretching, twisting, jabbing, lunging, rolling, falling, jumping, hand locks, and the use of various martial arts and fitness equipment. I realize that these activities, as well as all other martial arts activities, can be dangerous, but I am voluntarily choosing to participate in some or all of these activities and agree to assume the risk associated with my participation therein.

 

I understand that I am assuming full responsibility for any and all risks of death, personal injury, emotional pain and suffering, property damage and economic loss that might be suffered by me as a result of my participation in martial arts classes at Taijutsu. I agree that this release shall bind me, my spouse, my heirs, my personal representatives, my assigns, my children and my and their agents. I hereby further agree to release, indemnify and hold completely harmless Taijutsu, and all other entities associated with Taijutsu, and their members, officers, directors, agents, employees, heirs, assigns and independent contractors harmless from any and all liability and costs, including attorney fees, associated with or arising from my participating in martial arts classes / training at Taijutsu, waiting at or on Taijutsu Brisbane premises to participate in such classes / training, and walking through the premises at Taijutsu prior to or after such classes/training.

 

I understand that if I were to file a law suit against Taijutsu, or any other entity associated with Taijutsu and/or their members, officers, directors, agents, employees, heirs, assigns and independent contractors, as a result of any personal injury including death, emotional pain and suffering, property damage or economic loss suffered by me as a result of my participation in martial arts classes / training at Taijutsu, waiting at or on Taijutsu premises to participate in such classes / training, and walking through the premises at Taijutsu Brisbane prior to or after such classes / training, that this release would bar the lawsuit and the court would dismiss it on the grounds that by signing this release, I have expressly assumed all the risks associated with participation in such activities, including but not limited to negligence on the part of the martial arts / fitness instructors in the performance of their duties, negligence by other members of Taijutsu, negligence in the operation of machinery or equipment, and/or premises liability.

 

If I am agreeing to this release on behalf of a minor child, I understand that I am giving up the same rights for the said minor as if I agreed to this release on my own behalf. I have read this agreement and understand the words and language in it and I am advised of all potential dangers incidental to participation in martial arts classes/training at Taijutsu, including travel to and from.

 

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT, AND HAVE AGREED TO IT FREELY AND VOLUNTARILY WTHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY ACCEPTANCE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

PAYMENT TERMS & CONDITIONS

In accordance with this Student Enrollment Agreement and for the services described therein, I hereby authorize ‘Taijutsu’ to debit my account; or my credit card account in accordance with the terms described in this Student Enrollment Agreement.

I accept that payments presented against my account that are returned unpaid will be automatically re-processed prior to the next installment due date. ‘Taijutsu’ will action the debit on the date/s nominated, however due to individual bank processing times, it may take several days to register with your account. It is the responsibility of the payer to ensure the funds are available until the transaction has been completed.

I understand that under the terms of this agreement, the school obligates itself to furnish me with competent instructor and suitable facilities for teaching lessons. Qualified instructors trained in the procedures and traditions of the Martial Arts supervise all class sessions. The private tuition rate $120.00 per hour; however, a substantial discount has been provided to me by virtue of enrolling in a regular course.

I understand that payments are weekly installments and I have agreed to pay the tuition in regular installments over an undefined period of time until the date at I wish to cancel the service.

Enrollment provides the students with the opportunity to attend the specified number of classes. Failure of the student to attend the appropriate number of lessons does not relieve me of my obligation to pay for their enrollment in full. My payment schedule is not affected by the lessons schedule and/or attendance of the students listed on this Agreement.

Promissory Note: THE UNDERSIGNED PROMISES TO PAY the “Total Budgeted Tuition” in equal installments on the designated “Due Date” to be paid DIRECTLY to ‘Taijutsu’ until paid in full. Failure to complete the training  does not relieve the student of paying the tuition in full. 

 

NOTICE OF CONSUMER RIGHTS

1. You may cancel this agreement at any time and without a cancellation fee. Cancellation requires 28 days’ notice to terminate this agreement. Notice of cancellation shall be in writing via both text message and email (info@taijutsu.org) to the School. 

2. Suspension of membership payments can be actioned at any time and must be for a minimum period of two weeks and maximum of twelve weeks. The Payer’s installment payments must be current and up to date. Applications to suspend this Agreement must be submitted in writing (text message and email) to the School prior to the student/s absence and include the intent to suspend payments for a start and return date range. A suspension fee of $5.95 will be incurred for the duration of this period.

 

3. If the School is closed for four weeks or more, you are entitled to a prorated refund, except if the closing is not the fault of the facility; in which case the choice of remedy is the School’s. The School will close for up to 3-weeks over the Christmas period, dates will be announced in advance.

PRIVACY POLICY

1. PHOTO, VIDEO, AUDIO RELEASE: The Buyer agrees that the School may take photographs and may make video and audio material of Student’s classes and schools events, and that these materials may be used for display, promotion and/or advertising, or sold for profit, and the Student hereby waives any compensation to which they may otherwise be entitled for appearing in such materials.

2. ‘Taijutsu’ and the School understand the importance of, and are committed to complying with, the Privacy Act (1988) and the National Privacy Principles. We only collect information that is necessary for us to effectively manage your tuition payments and provide you with Martial Arts lessons. In the event of non-payment, we may contact out services that involve disclosing your information to other organisations (including legal advisors and collection agents). A copy of our full Privacy Policy is available from the School on request.

3. This Notice of Consumer’s rights is an integral part of the Application and Agreement for Membership.
